| In addition to basic estate
planning, advanced estate planning services, such
as irrevocable life insurance trusts (ILITs) and
charitable remainder trusts (CRTs) are provided.
Entity selection and formation services are also
available to clients in conjunction with their estate
planning. The more typical entities include corporations,
both C and S, Limited Liability Companies, and various
partnerships. In appropriate circumstances, the
entity formation services will include business
succession consultation and a buy-out agreement.
Occasionally the situation
arises where an estate plan has already been established
and one of the spouses has passed on. At that
point, there may be trust administration or explanation
issues to be addressed. Sometimes the surviving
spouse may discover that the estate plan is contrary
to what the spouses had intended when the plan
was established. Even though the plan may now
involve an irrevocable trust, there may be sufficient
legal grounds to have the irrevocable trust modified
by the Probate Court to comport to the original
wishes of the spouses.
